Regarding: Private Sector Gift - Computer and Networking Equipment

Your letter concerning same received on 9/17/97

Dear Mr. Lamb:

It is our understanding that Ms. Darlene Johns of Alphnumerics, Inc. will arrange for several different computer equipment vendors to donate to the Office of the Lieutenant Governor computer and networking equipment. The equipment will be a gift to the State of North Carolina and will remain in the Office of the Lieutenant Governor until such time as it is disposed of in accordance with the rules of the State.

Providing there is not a direct or indirect understanding, expectation, or prospect that the Office of the Lieutenant Governor will take any actions or exercise of forbearance that would be of specific benefit to Ms. Darlene Johns of Alphnumerics, Inc. or any of the vendors donating the equipment, the Board of Ethics does not see an ethical problem in accepting the donations.

Our opinion is not intended to prohibit Ms. Johns or any of the venders involved from doing business with the State of North Carolina including the Office of the Lieutenant Governor in accordance with established purchasing rules.
