The Commission has the authority to determine whether an entity is subject to the State Government Ethics Act, Chapter 138A, and does so utilizing non-exclusive criteria adopted April 24, 2009. The Commission must identify and publish, at least annually, a listing of all boards to which the Act applies. The Commission must identify and publish, at least quarterly, a listing of the names and positions of all individuals subject to Chapter 138A as covered persons or legislative employees.
