Formal Advisory Opinions - Legislative Ethics Committee Opinions: sections 120-104 & 138A-13

Advisory opinions are one of the cornerstones of ethics regulation in North Carolina. They allow requesters to receive prospective advice about real life situations they face in their public service, and formal opinions provide the requester with limited immunity if they follow the advice given. Please see sections 120-104 and 138A-13(b) for more information about the requesting and issuance of formal advisory opinions for legislators.

The Ethics Commission will publish the Legislative Ethics Committee's advisory opinions at least once a year. They will be edited as necessary to protect the requester's identity. This section contains advisory opinions issued by the Legislative Ethics Committee pursuant to section 120-104 dealing exclusively with advice given to legislators.

If you would like to speak with Commission staff about obtaining an opinion, please call (919) 807-4620.
